Terms of use
What you can expect from WAF, and what WAF expects from you. What you upload stays yours.
This is a courtesy translation. The French version is the legally binding one. Read the French version
1. Purpose
These terms of use govern the use of the WAF service, published by Cédric Vanderstraeten, available at waf.fm and through its embeddable players (iframe, Miro, Notion and the like). WAF hosts audio and video files, shares them by link and collects timestamped comments.
Using the service — including simply listening or leaving a comment through a share link, without an account — means accepting these terms.
2. A service in beta
WAF is in beta. The service moves fast: features appear, change or disappear, and incidents remain possible. The plans and their prices appear on the Pricing page. No payment is collected to date. The paid plans will open after the publisher is registered; their terms of sale will be published beforehand and will have to be accepted before any subscription.
3. Account
- Creating an account requires a valid email address. Signing in happens with a password or with a link sent by email.
- The service is reserved for people aged at least 15.
- You are responsible for keeping your credentials confidential and for the activity carried out from your account. You can enable two-factor authentication with an authenticator application; we recommend it.
- The WAF desktop application signs in to the same account. It sends us no telemetry; its updates are served by waf.fm.
- The Studio plan gives access to API keys to automate uploads. A key is a means of access in its own right: keep it secret, do not share it, and revoke it from the settings as soon as it is no longer used. We show it only once, at creation, and keep only a fingerprint of it.
4. Your content
You remain the owner of everything you upload. WAF acquires no intellectual property right over your files or your comments.
By uploading content, you grant WAF a non-exclusive, worldwide, royalty-free licence, strictly limited to what is technically necessary to run the service: storing the content, transcoding it (playback formats, waveforms, thumbnails), delivering it to the people holding the share link you created, and displaying it in the embedded players. The licence goes no further: it allows no promotional or commercial exploitation of your content, no resale, and no analysis or training by an artificial intelligence service. It ends when the content or the account is destroyed — deleted content stays 30 days in the bin, unless you empty it —, subject to the technical delay of rotating backups.
You warrant that you hold the rights needed over the content you upload, including third-party rights (music, voices, images), and you indemnify WAF against any claim on that basis.
Share links are unlisted, but reachable by anyone who holds them. They are drawn at random and excluded from search engine indexing. You can protect them with a password, set a closing date or renew them. A listen already started may nonetheless continue for up to an hour after a link is closed or renewed. It is up to you to pass them only to the intended recipients.
Multiple uploads. You can upload several files and group them into a batch, which gets its own sub-folder and a single share link to hand to a client. Cancelling a batch revokes its share link and moves its folder to the bin, where it stays recoverable for 30 days. A folder's ZIP archive is never kept: it is built at the moment of download.
5. Shared folders, members and removal
A folder may bring several people together. The owner — the person who owns the folder or, for a file uploaded outside any folder, the person who uploaded it — keeps control of it: they invite and remove members, and it is their plan that determines how long the folder's files are retained.
A member, even one who uploaded files into the folder themselves, loses all access to the folder and its content if that access is withdrawn. The files they uploaded there stay in the folder and remain the property of their authors; their use continues to fall to the owner. The removed member keeps control of their own comments and can edit or delete them from their account. This rule is justified by the confidentiality of the work entrusted: a client who has left a project must no longer be able to view its deliveries.
6. Prohibited uses
The following are prohibited, among others:
- uploading infringing content or content that harms the rights of third parties;
- uploading illegal content;
- using the service for spam or for mass distribution of files unrelated to creative work;
- any attempt to circumvent plan limits, to access third-party content without authorisation, or to disrupt the service.
WAF may remove manifestly illegal content and suspend or terminate an account in the event of a serious or repeated breach. Except in an emergency — manifestly illegal content, risk to third parties — the owner is given formal notice beforehand.
7. Hosting provider status — reporting
For the content of its users, WAF acts as a hosting provider (article 6 of French law no. 2004-575 of 21 June 2004; regulation (EU) 2022/2065) and carries out no general prior monitoring. Any illegal content can be reported to contact@waf.fm, following the procedure set out in the legal notice.
8. Availability and retention
The service is provided as is. We aim for the best availability we can and we watch for incidents, but the beta comes with no contractual service level commitment: no guaranteed uptime, no guaranteed restoration time.
Backups are in place — the database is replicated continuously and media are kept on redundant object storage — but WAF is not an archiving service: keep your originals.
File retention: on the Free plan, files expire automatically 30 days after upload, with a reminder sent by email before the deadline. On the Pro and Studio plans, they are kept for as long as the account exists. When a paid subscription ends, the account falls back to Free: the files are kept for 30 days after the end of the paid period, then expire under the Free plan rules. The deadline applied to a file is that of the owner of the folder it sits in, not that of the person who uploaded it.
Should the service be discontinued, or a substantial feature removed, account owners are warned with reasonable notice so they can retrieve their files.
9. Liability
WAF is not liable for the content uploaded by its users, nor for the use recipients make of the share links passed to them. WAF's liability, whatever its cause, is limited to direct and foreseeable damage. Nothing here excludes liability that cannot be excluded by law.
10. Personal data
The processing of your data is described in the privacy policy.
11. Termination
You may stop using the service at any time. You can delete your files and then your account from the settings, following the path described in the privacy policy, or ask for it at contact@waf.fm.
12. Changes to these terms
WAF may amend these terms. Account owners are informed of substantial changes at least 15 days before they take effect; continued use means acceptance.
13. Governing law
These terms are governed by French law. Failing an amicable settlement, disputes fall to the competent French courts under ordinary rules of jurisdiction.
